(3) If companies and individuals are together to apply for a patent abroad, it should be agreed by one of the entities which meet the eligibility declaration condition. They shall submit for enterprise business license of each entity or the certificate of legal institutions and research institutions, and every natural person, a copy of identity documents with the stamp of seal of the respective entity on it (natural person identity materials simply affix to stamp an official seal).
III. Procedures
The state owned company can file the application to the Ministry of Finance through the State Intellectual Property Office applications (for companies outside Beijing, to facilitate the application they can submit the application materials through their provincial department of intellectual property to the State Intellectual Property Office), local companies can file through the provincial sector to the provincial finance department. The State Intellectual Property Office and the provincial finance department examine and later issue an official document, while in official report of examination the each item should be mentioned, especially on the main reason for filing and situation, and gave a brief introduction and summary of all the items, the provincial department of intellectual property should submit all the above documents to the State Intellectual Property Office Ministry of Finance and the State Intellectual Property Office will arrange experts to examine the project and make assessment.
IV Time limit
The time limit is from July 1, 2010 to August 15, 2010. (see Instructions for filling forms on the website of to the State Intellectual Property Office (www.sipo.gov.cn). After the State Intellectual Property Office and the provincial finance department examines and assesses the projects, the formal filing materials should be submitted to the Ministry of Finance before August 30, 2010. Otherwise, the applications will be considered as abandoned.
