Notice of Special Fund for the Subsidy of Foreign Patent Application
In order to give good arrangement of special fund for the subsidy of foreign patent applicaiton, according to "Ministry of Finance on the issuance of Notice " (Finance Building [2009] No. 567), now please find the following detailed content of the above notice:
I. Conditions:
Filing the application for the special fund of foreign patent (hereinafter referred to as special funds), the following conditions must be met: (A) Objects The applicant should have the legal personality of domestic SMEs, public institutions or research institutions. If the legal representative is the applicant of patent, then the company of its can file the application for special funds. (B) Filing Items The filing items should be patents filed to the State Intellectual Property Office by the Patent Cooperation Treaty (PCT) channels. Those Which have access to the central government on technology research and development funds and local financial support shall not repeat the filing of funding. (C) Costs. 1. Expenses during application The 2010 special fund used to subsidize domestic applicants to the foreign patent applications, refers to the expenses the incurred from July 1, 2009 to June 30, 2010. 2. The categories of cost. Pay the official fee for the patent examination, including: during international phase the international application fee, searching fee, delivery fee, preliminary examination fees, fees and other costs; foreign national stage of the review fees paid abroad, the registration authority fees, annual fees, license fees three years (subject to the provisions of national law); to the patent agency paid services; to search patent search organizations pay the cost. 3. The amount of cost The maximum of support for each patent is up to the five countries (regions) to apply, and the amount of subsidy for each country (region) is not more than 10 million, excluding a major innovation.
II. Required materials
Each applicant should submit the following materials: 1. Forms of "2010 special funds to the foreign patent application" (see Annex 1). 2. The principal eligibility and qualifications. (1) The applicant shall submit a business license, or legal institutions and research institutions a copy of the certificate and official seal affixed to declare. If its legal representative is to apply for a patent abroad, the applicant should also submitt, "the legal representative of the Certificate of Identity" (see Annex 2). (2) Two or more entities jointly apply for a patent abroad, should be agreed and applied by one of the entities which meet the eligibility declaration conditions. The applicant also shall submit the enterprise business license of each entity, or a copy of the certificate legal institutions and research institutions with stamp of seal
